These Terms of Use govern your use of the website zhar.cc (the "Website") and its associated services (waitlist, newsletter, product information), operated by Oleg Butov, Berlin, Germany ("Provider" or "we").

By using the Website you agree to these Terms. If you do not agree with any provision, please refrain from using the Website.

The Website provides product information, updates, and waitlist registration for early access to the ZHAR application. Registration does not guarantee access to the beta or the final product.

We may update, change, or remove content at any time. Features, roadmaps, and timelines are directional and may change. No right to specific content or features arises from the use of the Website.

All content on the Website — including text, graphics, logos, images, and software — is protected by German copyright law and other intellectual property legislation. Reproduction, modification, distribution, or any form of exploitation beyond the limits of copyright law requires the prior written consent of the Provider, unless the content is explicitly marked as open source.

The Website is provided "as is". We make no warranties regarding uninterrupted availability, the accuracy, completeness, or timeliness of information, or fitness for a particular purpose.

7. Limitation of liability

The Provider is liable without limitation for damages arising from injury to life, body, or health caused by intentional or negligent breach of duty, as well as for other damages caused by intentional or grossly negligent breach of duty.

In the event of slightly negligent breach of material contractual obligations (cardinal obligations), the Provider's liability is limited in amount to the foreseeable, contract-typical damage at the time the contract was concluded. Material contractual obligations are those whose fulfilment is essential for the proper performance of the contract and on whose compliance the user may regularly rely.

Beyond the above, liability for damages caused by slight negligence is excluded.

The above limitations of liability also apply in favour of the Provider's legal representatives and vicarious agents.

We reserve the right to amend these Terms of Use with prospective effect at any time. The current version is always available on this page. We will notify registered users of material changes by email.

10. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a merchant, legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin.

For consumers, the statutory place of jurisdiction applies.

11. Severability

Should any provision of these Terms be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic purpose pursued by the parties with the invalid or unenforceable provision.
